Goligher v Flow Part Ltd

Civil procedure – Personal injury – Pleural plaques – Sist of action: Sheriff Court: Refusing motions by the defenders in 18 personal injury actions involving pleural plaques in the Sheriff Personal Injury Court to sist the actions for 8 weeks and suspend the timetable for that period 'in order that the pursuer's statement can be produced and considered with view to settlement proposals being made' the court concluded, inter alia, that the proposed sist would not in fact give the defenders any more time than they currently had within which to try to effect a settlement, and it was reluctant to grant any sist which had little, if any, practical effect, nor did it see any purpose in granting a sist where it was conceded that the court did not have the power to compel the pursuers to produce the information in question.
