The claimant company's claim succeeded in a dispute in which a vessel had incurred costs while waiting offshore, owing to congestion at the port where it had been intended to unload its cargo. The Commercial Court held that the claimant was entitled to compensation for the service that it had provided to the defendant company at the demurrage rate for the days that the vessel had spent at the waiting area, and for the bunkers consumed during that period.
