Medical practitioner – Professional conduct committee. Given that Ivey v Genting Casinos (UK) Ltd (trading as Crockfords) ([2017] All ER (D) 134 (Oct)) clearly established that the second limb of the test in R v Ghosh ([1982] 2 All ER 689) should not be applied, it was inappropriate to determine whether the Medical Practitioners Tribunal (MPT) had erred in having applied the second limb of the Ghosh test, as argued by the appellant General Medical Council and the first limb, as argued by the respondent. Accordingly, the Administrative Court quashed the MPT's decision and remitted it to the same panel.
