Gathurah (aka Mohamed) v Secretary of State for the Home Department

Immigration – Detention. The Administrative Court held that the defendant Secretary of State's decisions to detain the claimant had been unlawful, but the damages would be nominal and he had no claim for damages for his removal in breach of a court order. Further, the Secretary of State's decision to reject his further representations as a fresh claim, and to refuse to cancel removal directions and to release the claimant had been lawful.
