Gard Shipping AS v Clearlake Shipping Pte Ltd

Shipping – Charterparty. The Commercial Court dismissed the claimant owners' claim in a dispute over whether the owners were entitled to claim demurrage at an escalated rate, and the value of bunkers consumed, while a vessel had been waiting to discharge cargo at Rotterdam. The court held that the charterparty was to be construed as contended by the charterers, and that it was not appropriate to imply a term into the contract.
