European Union – Access to information. The General Court of the European Union allowed the action by Gameart sp. z o.o., for annulment of a decision of the European Commission in so far as it had refused the request by that company for access to documents drawn up by Poland, a request which had been forwarded to the Commission by Poland on the basis of the second paragraph of art 5 of Regulation (EC) No 1049/2001. The General Court held that the Commission had not been competent to adjudicate upon that request since art 5 of that regulation expressly stated that its substantive scope was limited to documents 'originating' from EU institutions. Accordingly, the Commission had infringed that provision.
