Medical practitioner – Negligence. The defendant NHS trust had failed to discharge its responsibility of informing the claimant of the outcome of treatment, the prognosis, of any requirement for follow up and further treatment or monitoring after he had undergone treatment to remove a gastrointestinal stromal tumour in 2001. The Queen's Bench Division held, amongst other things, that, had the defendant discharged its duty, the claimant would have undergone annual CT scans and the recurrence of the tumour would have been detected and operated upon four years earlier than had been the case. The claimant was awarded a total of £38,731.12 in damages.
