Judgment – Default judgment. The Queen's Bench Division set aside default judgment entered against the defendant in the claimant's proceedings against him for libel. The weakness of, and the unanswered questions about, the claimant's expert report, expressing the opinion that one of the defamatory letters had been written by the defendant, indicated that the defendant had a real prospect of success, despite his inordinate delay.
