The Upper Tribunal (Administrative Appeals Chamber) quashed the First-tier Tribunal's decision, confirming the respondent Secretary of State's decision that the appellant Spanish national was not entitled to employment and support allowance, as part of the record of proceedings was missing and it could not be sure of the evidential basis for it. Further, only at UK domestic law, although the appellant had not had a permanent right of residence at the date of her claim, she might have acquired one before that claim had been decided.
