Fuzesi and another v Budapest-Capital Regional Court, Hungary and another

Extradition – Prohibition on torture. The failure to identify a specific prison at which the first appellant would be detained if extradited to Hungary, as had been done in the second appellant's case, did not fail to meet the systemic risk of breach of art 3 of the European Convention on Human Rights due to overcrowding. Accordingly, the Divisional Court dismissed the appellants' appeals against orders for their extradition to serve sentences of imprisonment.
