Damages – Loss of society – Title to sue – Effect of adoption law. Court of Session: In action of damages for loss of society in respect of a deceased who was validly adopted, in which a question arose as to whether the biological half-brother and half-sister of the deceased, both born long after his adoption, had title to sue, the court held that the Damages (Scotland) Act 2011 did not give any entitlement to sue to biological members of the family of a deceased who had been adopted and dismissed the action so far as relating to the sixth and seventh pursuers.
