European Food SA v European Union Intellectual Property Office

European Union – Trade marks. The General Court of the European Union allowed the action brought by European Food SA (EF) for annulment of a decision of the Fourth Board of Appeal of the European Union Intellectual Property Office relating to invalidity proceedings between EF and Société des produits Nestlé SA, regarding the application by the latter for registration of the word sign 'FITNESS' as an European Union trade mark.
