Practice – Service out of the jurisdiction. The Queen's Bench Division dismissed an application issued by three defendants to set aside the court's grant of permission to serve outside of the jurisdiction, in a case where the claimant betting agency had brought claims for debts owed, conspiracy to defraud, breach of contract, and fraudulent misrepresentation against defendants based in Peru. The claimant succeeded in showing that there was a serious issue to be tried, and that it had a good arguable case that each of the claims fell within the jurisdictional gateways set out in para 3.1 of CPR PD 6B.
