Environment – Protection. The Divisional Court allowed the appeal, by way of case stated, by the Environment Agency against a decision of the magistrates' court which had dismissed informations against the respondents who each owned unregistered vessels kept in the two marinas at issue. The Divisional Court held that, on the correct interpretation of s 4 of the Thames Conservancy Act 1932: (i) the marinas at issue formed part of the river Thames; and (ii) it necessarily followed that the Environment Agency (Inland Waterways) Order 2010, SI 2010/699, applied to vessels kept in either of those two marinas.
