The Court of Justice of the European Union ruled that a fuel storage site of a coal-fired power plant was part of an 'installation' within the meaning of art 3(e) of European Parliament and Council Directive (EC) 2003/87. Further, the first sub-paragraph of art 27(2) of Commission Regulation (EU) 601/2012 meant that coal lost as a result of the process by which it naturally self-heated while in storage on a site that was part of an installation could not be regarded as coal exported from that installation.
