Occupier's liability – Standard of care. The Court of Appeal, Civil Division, in allowing the defendant local authority's appeal and dismissing the claimant's cross-appeal, held that the judge had been wrong to find the authority liable for the claimant's injury, after he had fallen from a bridge and suffered serious injury. In the circumstances, there had been no requirement to provide the bridge with a better type of side barrier and it was the case that not every accident had to have been the fault of another.
