Copyright – Infringement. The Chancery Division held that third defendant joint composer of the song 'Alright, Alright, Alright' (the song), which had been one of several hit songs by the band 'Mungo Jerry', had to reimburse the fifth defendant company (AMI) for £33,600, which AMI had paid to the claimant music publishing company in settlement of a claim for copyright infringement. The court held that AMI had entered into an assignment agreement, which had purportedly assigned copyright in the song, after it had relied on R's misrepresentation that his company owned the copyright in the song. However, the court held that AMI was not entitled to any damages claimed for lost royalties.
