Dunsire v HM Advocate

Criminal evidence – Admissibility of evidence – Detainee's police interview. High Court of Justiciary: Refusing an appeal against a decision to refuse a preliminary issue minute which objected to the admissibility of evidence of the appellant's police interview in the course of his detention in June 2015, the appellant having first been detained three months earlier, questioned about involvement in drugs transactions and released without arrest or charge, the court held that the preliminary hearing judge had not erred as it was satisfied that the appellant's second detention in June 2015 was not on the same grounds as the first detention in March 2015 and his second detention was not illegal.
