Road traffic – Goods vehicle. The Queen's Bench Division ruled on an appeal by way of case stated by the Driver and Vehicle Standards Agency against the magistrates' court's decision to acquit the defendant of using a vehicle without an operator's licence, contrary to s 2 of the Goods Vehicles (Licensing of Operators) Act 1995; and using a vehicle without a tachograph contrary to s 97 of the Transport Act 1968, as amended. The court upheld the judge's decision to acquit the defendant on the first charge on the basis that the defendant's vehicle was a 'showman's goods vehicle' and therefore fell within the relevant exemption, but declined to rule, without further material, on whether the judge had been correct to conclude that the second exemption followed from the first.
