Insurance – Misrepresentation. The Commercial Court dismissed the claim of the claimant company, following the decision of the defendant underwriters to avoid a policy of insurance when the claimant's property was damaged in a fire. The court held that the claimant had made a number of misrepresentations at the renewal of the policy so that a fair presentation to the risk of the defendants had not been made, and that it had breached conditions in the policy. Declarations of non-liability, as sought by the defendants, were made.
