Dabrowski v Regional Court in Radom (Poland)

Extradition – Extradition order. The Divisional Court allowed the appellant's appeal against orders for extradition to Poland to face trial for robbery, as the judge had failed to properly carry out the balancing exercise concerning art 8 of the European Convention on Human Rights (art 8), both in his approach and in relation to the need to take account of relevant factors. The consequences of extradition for the appellant were at a sufficient level of severity to render extradition incompatible with his rights under art 8.
