DHL Supply Chain Ltd v Secretary of State for Health and Social Care

Public procurement – Public contract. The claimant company's application for summary judgment in a tendering dispute failed. The Technology and Construction court held that the defendant secretary of state (the DHSC) had a real prospect of successfully defending the claim. Further, the DHSC succeeded in an application to lift an automatic suspension which had taken effect on the issuing of proceedings, and which prevented the DHSC from entering into a contract with the successful tenderer.
