Cumming v SSE plc

Civil procedure – Personal injury – Pleural plaques – Expenses. Sheriff Court: In a personal injuries action by a pursuer with pleural plaques which settled for £9,175 and in which the defenders opposed the pursuer's motion seeking sanction for the employment of junior counsel, the court was satisfied that the proceedings were such as to merit the employment of counsel having regard to their difficulty or complexity, coupled with the importance or value of the claim to the pursuer.
