The General Court of the European Union dismissed the action brought by the applicant against a decision of the Fourth Board of Appeal of the European Union Intellectual Property Office, upholding the Board's finding that the applicant's application for registration of the mark 'LUCEO' was filed solely so as to be able to oppose the application for registration of the trade mark 'LUCEA LED' filed by the intervener and to derive economic advantages from that opposition.
