Conflict of laws – Jurisdiction. The claimant's claim for damages arising out of an accident that occurred whilst he was in France on a holiday was contractual in nature, governed by Regulation (EC) 593/2008 (Rome I) and accordingly would be dismissed. The Court of Appeal, Civil Division, held that as a matter of autonomous EU law, the pleaded strict liability claim, despite the reliance on the French Law was and remained a claim that was contractual in nature, and therefore one to which the Rome I applied.
