Commissioner of Police of the Metropolis v Brown; Chief Constable of Greater Manchester Police v Brown (Equality and Human Rights Commission intervening)

Costs – Order for costs. The question to be asked in determining whether the automatic protection of the qualified one-way costs shifting regime (QOCS) contained in the CPR Pt 44 applied was whether the claimant was claiming anything other than damages for personal injuries. The Administrative Court held that, if the answer was no, then QOCS protection applied automatically, but if the answer was yes, then the case was subject to the court's discretion under CPR 44.16(2)(b).
