Coghlan v Chief Constable of Cheshire Police and others

Malicious prosecution – Prosecutor. The claimant's claim against the Chief Constable of Greater Manchester Police and the Director General of the National Crime Agency for malicious prosecution were dismissed, as there had never been a proper basis for contending that the murder case alleged against the claimant was prosecuted by them. The Queen's Bench Division also entered summary judgment in favour of the Chief Constable of Cheshire Police, as he had investigated the circumstances and placed the results of his investigation before the Crown Prosecution Service, which had made the decision to charge the claimant.
