Contempt of court – Comittal. The Queen's Bench Division dismissed the applicant's application for committal of the respondent, an investigator of the former Serious Organised Crime Agency (SOCA), for contempt of court. The court held that the applicant had not proved to the requisite standard that the respondent had had no honest belief in the truth of what he had been saying in his witness statement concerning the evidence which the respondent had relied on in proceedings for a recovery order brought by SOCA against the applicant under Pt 5 of the Proceeds of Crime Act 2002.
