Clarke v General Optical Council

Medical practitioner – Appeal against determination of disciplinary committee. The Administrative Court held that the appellant optometrist's appeal against the decision of the General Optical Council's Fitness to Practise Committee on review (the FTP), finding impairment and erasing him from the register, would succeed. The FTP had failed properly to consider all the principles that it had been duty bound to consider, in particular, the appellant's retirement and the previous FTP's conclusion that erasure would be disproportionate.
