Charles v Mugla Chief Public Prosecution Office, Republic of Turkey

Extradition – Extradition order. The Divisional Court, in allowing the appellant's appeal against orders for his extradition to Turkey to serve a sentence for rape, held that his extradition was not compatible with art 3 of the European Convention on Human Rights. There was a real risk that the appellant might end up in solitary confinement, which would clearly cross the threshold of inhuman and degrading treatment.
