Cavanagh and others v Secretary of State for Work and Pensions

Employment – Trade union. The Queen's Bench Division held that the first and second claimant employees, having opted to have their subscriptions to the third claimant union deducted from their salary and paid by the defendant Secretary of State to the union, had a contractual right to insist that he continued with that arrangement. Further, the union could enforce that right under the Contracts (Rights of Third Parties) Act 1999.
