In a claim for personal injuries arising from a stroke the claimant suffered shortly after carrying out an abseiling exercise at the defendant company's abseiling centre, it had not been established, on the balance of probabilities, that the claimant's neck injury had been occasioned by negligently permitted slack in the safety rope. Accordingly, the Queen's Bench Division, dismissed the claim.
