Contract – Repudiation. The claimant company's claim for the vacation of unilateral notices succeeded. The notices had been entered into by the defendant company on the charges register of title, on the basis that an assigned contract for the sale of the land by the claimant to the defendant had been terminated by the claimant's acceptance of the defendant's repudiatory breach in failing to complete the sale. The Chancery Division, in dismissing the claim, held that the claimant had successfully rescinded the contract of sale.
