CN and another (through their Litigation Friend the Official Solicitor) v Poole Borough Council

Negligence – Duty to take care. The claimants' claim against the defendant local authority pleading a direct duty of care derived from the statutory duties under the Children Act 1989 would be struck out. The Court of Appeal, Civil Division found that applying conventional principles of common law, and in the absence of an assumption of legal liability, there would be no liability in the present case.
