Bullard v Bullard and another

Variation of trusts – Settlor's application. The Chancery Division allowed the claimant settlor's application with regard to the application of a clause in a trust deed. Although the true construction of the deed did not favour the claimant's preferred interpretation, there was no objection to granting the remedy of rectification in the present case, which allowed the deed to be interpreted as the claimant had intended.
