Section 90(1) of the Housing Act 2004 had not conferred the power to impose the two disputed conditions namely, conditions requiring the installation of a carbon monoxide monitor and that the electrical installations met a prescribed standard. The Court of Appeal, Civil Division, held that such conditions had not fallen within the scope of the phrase 'the management, use or occupation of the house concerned'.
