BritNed Development Ltd v ABB AB and another

European Union – Rules on competition. The claimant company, which owned an electrical cable that supplied power, succeeded in part in its claim for breach of statutory duty against the defendant companies, which had been part of a cartel. The Chancery Division held that there had been an overcharge and that the claimant was entitled to recover €13,009,568. Among other things, the defendant companies' claim that they were protected by a regulatory cap on earnings failed.
