Sentencing – Level of discount afforded for plea of guilty. High Court of Justiciary: Allowing an appeal by an appellant who pled guilty to an amended charge of involvement in serious organised crime, and in respect of whom the sentencing judge selected a headline sentence of 8 years' imprisonment, to include 6 months for a bail aggravation, and discounted that to 7 years in light of the plea of guilty, which the Crown had accepted at a continued preliminary hearing, the court held that the judge had erred in determining the level of discount and it therefore quashed the sentence and imposed in its place a headline sentence of 8 years' imprisonment, discounted by approximately 20% to 6 years and 6 months.
