Conflict of laws – Jurisdiction. The Court of Appeal, Civil Division, dismissed the defendants' appeal against the judge's decision that the court had jurisdiction over conspiracy and breach of fiduciary claims against them, save to the extent the claims were for breach of fiduciary duty occurring whilst the defendants were employed by the claimants. The claimants had a good arguable case that the conspiracy claims fell outside arts 18(1) and 20(1) of the Lugano Convention and the fiduciary duty claims did not relate to contracts of employment, other than for the periods when the defendants had been employed.
