European Union – Environment. Article 220(6) of the United Nations Convention on the Law of the Sea and art 7(2) of Directive (EC) 2005/35, as amended by Directive (EC) 2009/123 should be interpreted as meaning that the expression 'clear objective evidence' within the meaning of those provisions covered not only the commission of a violation, but also evidence of the consequences of that violation. The Court of Justice of the European Union so held, among other things, in a preliminary ruling in proceedings concerning a fine imposed by the Finnish Border Protection Agency on the applicant company on account of an oil spill by a vessel in the Finnish exclusive economic zone.
