Criminal law – Anti-social behaviour order. The Queen's Bench Division, in dismissing the appellant's appeal, held that, on the proper construction of s 21(7) of the Anti-Social Behaviour, Crime and Policing Act 2014, the judge had correctly decided that conduct prior to 23 September 2014 could be taken into account in determining whether the appellant had engaged or threatened to engage in anti-social behaviour. However, he had erred insofar as he had concluded that evidence of such conduct should not also be taken into account in determining whether he had engaged or threatened to engage in anti-social behaviour.
