Aziz and others v Secretary of State for the Home Department

Immigration – Deportation. Although the First Tier Tribunal (Asylum and Immigration Chamber) had gone further than it needed to when assessing the lawfulness of the Secretary of State's decision to make an order to deprive the relevant appellant of his British citizenship under s 40 of the British Nationality Act 1981; the Court of Appeal, Civil Division, held that the fact that it had done so was not an error of law.
