Assoun v Assoun (No 3)

Practice – Payment out of court. The Court of Appeal, Civil Division, allowed the respondent wife's application for payment out of £30,000 that had been ordered to be paid in by the appellant husband. The payment into court had been to reflect a significant part of the debt owed by the husband, he could not make the court change its mind not to reopen the appeal and to rely on new evidence, and he had to discharge his debt to the wife.
