Association Justice & Environment z.s. v European Commission

European Union – Access to information. The General Court of the European Union dismissed the action by Association Justice & Environment, z.s. (AJE) for annulment of confirmatory Commission decision of 15 October 2015 refusing to grant AJE access to certain documents contained in the file of the infringement procedure 2008/2186 against the Czech Republic and regarding the application of Directive (EC) 2008/50. The General Court held that AJE had failed to demonstrate an overriding public interest in disclosure of the documents at issue with the result that they were fully covered by the exception laid down in the third indent of art 4(2) of Regulation (EC) No 1049/2001.
