Assens Havn v Navigators Management (UK) Ltd

European Union – Insurance. Article 13, point 5 of Council Regulation (EC) No 44/2001, considered in conjunction with art 14, point 2(a), thereof, should be interpreted as meaning that a victim entitled to bring a direct action against the insurer of the party which had caused the harm which he had suffered was not bound by an agreement on jurisdiction concluded between the insurer and that party. The Court of Justice of the European Union so held, in a preliminary ruling, in proceedings concerning reparation for damage caused to the applicant's port installations by a tug insured by Navigators Management (UK) Ltd.
