Aspen Underwriting Ltd and others v Kairos Shipping Ltd and others

Conflict of laws – Jurisdiction. The claimant hull underwriters had the better of the argument that their claim for damages allegedly caused by the third respondent Dutch bank's misrepresentations was a matter relating to tort and that the harmful event had occurred within the jurisdiction, with the result that the court had jurisdiction over that claim. However, the Commercial Court did not have jurisdiction over the claim in restitution.
