The Chancery Division allowed the respondent company's appeal against a decision of a Hearing Officer, which upheld in part an opposition by the respondent to the registration of the trade mark IWATCH to certain goods. The court held that the Hearing Officer had erred in his conclusion on the issue of the similarity of goods, and that error had been included as an important factor in his conclusion on the similarity of goods, leading to a mistaken conclusion.
