Once the issues in relation to the High Court's inherent jurisdiction and human rights obligations had been cleared away, the judge's order directing that DNA extracted from the deceased should be tested against a sample taken from the respondent, to prove whether the deceased was his biological father, had been right. Accordingly, the Court of Appeal, Civil Division, held that there was no basis for interfering with the judge's decision that, on the facts of the case, the order for DNA testing should be made.
