Employment – Unlawful deduction of wages. The employment tribunal (the tribunal) had jurisdiction to construe contractual terms in deciding whether a deduction of wages had been unauthorised. The Employment Appeal Tribunal so held in dismissing the employer's appeal. It further held that, while the tribunal had erred in considering whether a term needed to be implied into the relevant contract and by using the construct of the officious bystander, it had correctly concluded, on the facts, that the employer had made unauthorised deductions from the employees' wages following a pay settlement negotiated by collective bargaining between the RMT trade union and the employer.
