Insurance – Employers' liability insurance – Right of action to recover from insured. Court of Session: In an action in which the pursuers claimed to be entitled to recover from the defenders a sum they had paid to an employee of the defenders in satisfaction of a decree in absence in his claim for damages in relation to hand-arm vibration syndrome, the pursuers having earlier told the defenders they would no longer indemnify them because they were in breach of their contract of insurance, the court rejected the defender's contention that no relevant cause of action had been pled against them and the pursuers' contention that no relevant or sufficiently specific defence to the case had been pled.
